Code of practice
Please note your card will be charged for the full value of your
order on authorisation. Your goods will then be despatched as soon
as possible, subject to availability. All the prices listed on our
web site include VAT. This will be not be charged where applicable
(i.e. if the customer lives outside the EU).
All stock (including gifts) is offered subject to availability. If
the items you've requested aren't available when your order is
processed we will usually send the goods out as soon as they are
available, but if there is a long delay we may offer an alternative
product instead.
For the purposes of current UK distance selling legislation all
promotions associated with orders from Harvie & Hudson ltd
(including free gifts, prices, discounts, multi-buy savings and any
other similar offers) will cease to be valid when stock is no
longer available, unless otherwise stated and subject to
availability.
Confidential Mailing List: Harvie & Hudson Ltd observes the
code of practice covering the use of personal data as outlined in
the data protection act of 1984.
The right to refuse or restrict any order is reserved.
Delivery - Packing & Delivery Costs
Goods are usually sent by Royal Mail. We attempt to get
the goods out within 7 days of purchase.
The cost of packing and delivering your order is a standard £7.50
within the UK, £16.50 within Europe, and £19.50 to the rest of the
world (with some exceptions). This cost is fixed, no matter how
many items you order.
Returns - Cancelling your order
If you change your mind once you've placed an order, you have the
right to cancel the contract under the following conditions:
1. If your whole order remains un-despatched, we'll be happy
to cancel it and refund you in full, immediately.
2. If your order is in or has already been despatched, then
you have the right to cancel the contract, in writing, within 7
working days from the day after you receive the order.
Once we are in receipt of the goods, we will refund you in full
within 7 working days (Please allow up to 30 days). Please see the
Return Postage Costs section for how to return. The above complies
with Section's 9 to 14 of the Distance Selling Regulations
2000.
If returning to us from abroad please indicate clearly on the
package .goods returning to manufacturer for exchange/refund*.

When you can return something?
Any item you buy can be returned for refund or exchange within the
first 14 days on the proviso that you include the original
packaging and as long as it is fit for re-sale,. This service can
also be offered for up to three months, at our discretion.
Any item which has been sent to you in error can be returned for
replacement or refund within the first three months.
NB If for any reason you are returning your entire order you should
also include any additional items or gifts which were included with
that order.
Forms of Payment
Payment for goods can be made by the methods specified in our
website. We will always take all reasonable precautions to keep the
details of your order and payment secure but, unless we are
negligent, we cannot be held liable for any losses caused as a
result of unauthorised access to information provided by you.
Security Policy
You can buy from Harvie & Hudson easily and securely. When you
are ready to buy your selected items, your browser makes a
connection to the secure area of the site. At this point an icon is
shown and your information is then encrypted and safe.
Refunds
Where possible all refunds are processed within 7 day of receiving
the returned items.
If you paid for your order by credit card, debit card or cheque any
refund will be paid directly back into your account. If you paid by
postal order or gift voucher you will receive a postal order or
vouchers respectively for the refunded value
If any goods which form part of a multi buy are returned for
refund, the offer is invalidated and the refund amount will be
adjusted accordingly.
Replacements
If you return an item for exchange for the same item,
another size or colour, or different items of the same value, your
replacement will be despatched within 7 days of receipt (subject to
availability).
If goods are not faulty but are returned for exchange, the customer
is liable for replacement postage costs.
If you want to exchange for items of a higher value the same 7-day
period applies but we need you to enclose payment for the
difference with your returned item. If the replacement is of lower
value we will refund the difference. (NB Generally with credit
card, debit card we will refund the full amount and recharge for
the new value.)
Sometimes - particularly with orders placed at the end of a season
- the item you've requested as a replacement is no longer
available. If this happens we will pay back your full purchase
price as with any other refund. Occasionally we will replace the
item with something else; in this case if the replacement is of
lower value we will refund the balance of your originally
payment.
Return Postage Costs
We recommend that you return your items to us, using Royal Mail
Compensation Fee Parcel Post or your country's equivalent if from
abroad & obtain a certificate of posting for your
records.
Note: Harvie & Hudson Ltd will not be held liable for the
transit loss of any returned items/parcels.
You should also note that regretfully, Harvie & Hudson ltd does
not pay the cost of return postage. This does not affect your
statutory rights.
In the unlikely event that your order does go missing in transit,
of course we will arrange for our Carrier to track it down and
return it to us so it can be resent.
Currency Fluctuation
Foreign exchange rates are only shown as an indication. Credit card
exchange rates are set at the discretion of the individual credit
card company. All our charges are made in Pound Sterling.
Duties and Customs
If your order is to be delivered outside the European
Union, it is possible you may be charged import duty and local
sales taxes which must be paid upon receipt of the shipment. These
rules vary from country to country and your local government
determines duty and customs charges.
Accuracy of information
Every effort is made to be as accurate as possible when
describing ours other products represented on the website,
however, to the extent permitted by applicable law, we do not
warrant that the product descriptions, colours or other content
available on the website is accurate, reliable, complete, current,
or error-free. All sizes and measurements are approximate; however
we do make every effort to ensure they are as accurate as possible.
Please note that prices are subject to change without notice.
Data Protection and Privacy
We treat all of your personal information in accordance
with the applicable data protection laws in the UK. All information
is kept secure and processed fairly and within the law. Once data
is collected, we follow how you use the site using cookies. This
saves you time when you repeatedly visit our site. We also use it
for analysis to improve the shopping experience. If you wish us to

You may only use this website in accordance with the above
Terms and Conditions and, in any event, for lawful and proper
purposes which includes complying with all relevant laws,
regulations and codes of practice within the UK or other
jurisdiction from which you are accessing this website

You will find links to and from other websites We do not
endorse any such websites and we are not responsible for the
information, material, products or services contained on or
accessible through those websites. Your access and use of such
websites remains solely at your own risk.
Links to our website can only be allowed after we have given our
express written permission. We reserve the right to withdraw our
consent at any time to any links.
Limited liability
To the extent that we are lawfully able to do so, in no
event will we be liable for any direct, indirect, special,
punitive, exemplary or consequential losses or damages of
whatsoever kind arising out of access to, or the use of or
inability to use, this website or any information contained in it
or arising out of the services we provide, including loss of profit
and the like, whether or not in the contemplation of the parties,
whether based on breach of contract, tort (including negligence),
product liability or otherwise, even if advised of the possibility
of such damages. This does not affect your statutory rights.
Nothing in these Terms and Conditions shall exclude or limit our
liability for death or personal injury caused by negligence or for
fraudulent misrepresentation.
To the maximum extent permitted by law, we disclaim all implied warranties with regard to the information, services and materials contained on this website including but not limited to warranties of title, fitness for a particular purpose, merchantability and non-infringement of proprietary or third-party rights. All such information, services and materials are provided "as is" and "as available" without warranty of any kind.
Clearance Goods
The products in our clearance department are significantly marked
down. These items are not included in, or subject to, other offers
that we may run from time to time on this website (for example
percentage discounts off the value of your shopping basket) as they
have already been heavily discounted. Therefore, for items in the
clearance department no additional discounts are applicable to the
prices that they are already marked down to.
Indemnification
As the customer you agree to indemnify, defend and hold us harmless
from any liability, loss, claim and expense (including reasonable
legal fees) related to your breach or misuse of these Terms and
Conditions.
Intellectual property
The content and other material available on this website or which
forms part of the services, including, but not limited to, text,
graphics, logos, images, audio clips, button icons, data
compilations, software and the compilation thereof (the "Content")
is the property of Harvie and Hudson Ltd. The trademarks, logos,
and service marks displayed on the website (collectively, the
"Trademarks") are the registered and unregistered marks of Harvie
and Hudson Ltd, our affiliates, our licensors or our partners, in
the United Kingdom and other countries, and are protected by United
Kingdom and international trademark laws. All other trademarks not
owned by us, our affiliates, our partners or our licensors that
appear on the website are the property of their respective owners,
who may or may not be affiliated with, connected to, or sponsored

The Content, the Trademarks, nor any other portion of the website

None other than the owners (Harvie & Hudson Ltd) are permitted
to reproduce, sell or exploit for any commercial purpose any part
of the website or our services.
These Terms and Conditions will be interpreted and construed in
accordance with the laws of England and will be subject to the
exclusive jurisdiction of the English Courts.
